Terms & Conditions

These terms and conditions govern your relationship with Mogoza Ltd. Please read them carefully before making a purchase.

Definitions

Buyer/Customer/You or any such like term, means the person who places the order and agrees to buy goods, and or services from the supplier.

Supplier/Seller/Company/We/Us or any such like term means Mogoza Ltd.

System/Product term means all goods the customer agrees to buy.

The Specification term means the document setting out details of the security system which the buyer has ordered or agrees to buy.

The Conditions mean the conditions of sale set out in this document and any special conditions agreed in writing by the supplier.

General

These terms and conditions shall be governed by and interpreted in accordance with English law and any disputes shall be referred to the English courts. You may not assign, license or transfer any of your rights under these terms and conditions.

A person who is not party to these terms and conditions shall have no rights under the Contract (Rights of Third Parties) Act 1999.

Mogoza Ltd is not responsible for any breach of these terms and conditions caused by circumstances beyond its control. If any provision of these terms and conditions is found to be unenforceable or invalid, such invalidity shall not affect the other provisions of these terms and conditions which shall remain in full force and effect.

Statutory Rights

These “Terms & Conditions” do not affect your statutory rights as a consumer. Any changes to the terms and conditions must be confirmed in writing.

Placing and Order

In placing an order for one of our products, you are making an offer to buy that selected product, even if that product is awaiting stock and a deposit is taken.

Prices and Payment Terms

The prices for the goods and services will be the current prices that are agreed by us at the time the order is placed.

Deposits will only be taken when an expected delivery date for the next batch of stock is confirmed. The expected delivery date will be clearly specified, but Mogoza Ltd will not be held responsible if for any reason out of their control this delivery date is missed. Before delivery of goods full balance of payment must be taken, then the goods will be delivered.

Delivery

A condition of purchase is that you agree that proof of delivery supplied by our delivery company is sufficient evidence to establish that goods have been received.

All orders are fully insured against loss or damage whilst in transit, any damage must be reported within 48 hours of receiving your order.

Please note: If there has been no contact with the delivery company within 5 days of them leaving a card, the goods will be returned to us. If that happens and you still require the goods a delivery charge will have to be made before dispatch can take place. If you no longer require the goods, a refund will be made, less delivery and/or admin charges.

If you are not at home to receive your delivery, and you do not collect your package from the postal depot or re-arrange delivery, it will return to us. All re-deliveries are chargeable.

We offer secure delivery services, therefore ALL deliveries must be signed for. If you instruct that your order be left in a specific location (example; back of the house, behind a dustbin), where a signature cannot be obtained, this is entirely at your own risk and we take no responsibility for lost, stolen or damaged items in accordance with these Terms & Conditions.

Please note we do not deliver to shipping companies, the Channel Islands, Post Office boxes, hotels or guest houses. Goods cannot be collected.

We aim to ship all orders the same day that they are placed where the order is received before the cut off time and the items ordered are in stock.  In very rare cases an order containing items that are in stock might ship the following day. 

Parcels are delivered the next business day in the vast majority of cases. Parcel tracking information will be provided.

Mogoza Ltd reserves the right to charge a full shipping fee applicable to resend if the item is returned to us because the customer could not take delivery for any reason.

If you require a refund on items returned by the courier this will be done minus the courier’s fee.

If a customer inputs an incorrect address detail on their order, causing the parcel to be delivered incorrectly, we will not hold any responsibility for this parcel.ie, the customer will have to try and retrieve the parcel themselves at their cost.

Any delivery errors must be reported within 7 days of date of delivery. All orders are checked and double checked before leaving our warehouse. If you have not received your order within 7 days of dispatch date, then you must notify us within these 7 days. If you notify us after these 7 days then we will not be responsible for its location, and we may not be able to claim for the parcel if it lost/stolen.

Returns

You should be aware that once we begin the delivery process you will be unable to amend or cancel the order.

For online purchases, your rights to return goods are protected under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If you are returning goods because they have been damaged in transit you must inform us within 2 working days. This is so that we can make a prompt claim against the delivery company and correct the problem as swiftly as possible.

Before returning any goods, you must contact us via the Contact US page on our website, or via [email protected], and inform us you wish to return the goods, which goods, and why. Items returned without a valid returns number will be rejected. Refunds are made within 14 days. 

Product Care Guidelines

The Control Unit is splash proof only (Do Not leave out in the rain as it will invalidate warranty). 

Lighting Unit and Sensor Units are weather proof, not waterproof (If the Units are submerged in water it will invalidate warranty). 

Don’t look directly at the Security Lighting LEDs. 

Take care not to mark the Detection Lenses. 

Don’t use excessive force on any of the knobs. 

The Control Unit antenna is not removable. 

Clean the product with a damp cloth only (Don’t use chemicals or cleaning fluids). 

Don’t use abrasive materials on the product. 

Don’t spray the product with anything (lubricants, chemicals, etc.). 

Mogoza Ltd will not be held responsible for the use of our product in contravention of any fishery, environmental or radio regulations.

Warranty and Liability

Mogoza Ltd will repair or replace at our discretion any faulty product within 2 years from the date of purchase, provided proof of purchase is retained. 

We are not liable for faults resulting from misuse or negligence by you or others, or consumable items failing such as batteries. 

Mogoza Ltd may refuse to repair or replace where tampering has occurred, or units have been abused in contravention of Product Care Guidelines.

Except as may be implied by law, where the customer is a consumer, in the event of any breach of these Conditions by us the remedies of the customer shall be limited to damages which shall in no circumstances exceed the price paid for the goods. 

Mogoza Ltd is under no circumstances liable for any indirect, incidental or consequential losses or damage.

Force Majeure

In the event that we are prevented from carrying out our obligations under a contract for sale as a result of any cause beyond our control such as but not limited to Acts of God, war, strikes, flood and failure of third parties to deliver goods, we shall be relieved of our obligations and liabilities under the terms and conditions for sale for as long as such fulfilment is prevented.

No Waiver

The failure to exercise or delay in exercising a right or remedy under these terms and conditions does not constitute a waiver of the right or remedy or a waiver of other rights or remedies.

If we do not strictly insist on the performance of any part of these terms and conditions, we may still enforce all the conditions against you on other occasions. Failure to take any action against you if you break a condition does not mean that we will not take action against you if you break the same condition or other conditions again.

Complaints

If you have a complaint please contact us immediately. We will respond to your complaint within 48 hours of receiving the complaint and will do our best to find a speedy resolution. We will deal with all complaints fairly and confidentially.

Notice of the Right to Cancel

Under the Consumer Contracts Regulations, your right to cancel an order for goods starts the moment you place your order, and ends 14 days from the day you receive your goods.

Your cancellation right can be exercised by sending a cancellation notice to the email address: [email protected], or using the Enquiry form on the Contact Us website page, within the period of 14 days of receiving your goods. Please include your name, full address with postcode, order number, and reason for cancelling.

Cancellation Refunds

We will refund within 14 days of either getting the goods back, or providing evidence of having returned the goods (for example, a proof of postage receipt from the Post Office), whichever is the sooner.
